If your mortgage is in arrears, or a demand letter has arrived, or the file has already gone to the lender’s lawyers, the single most useful thing to know is this: the amount of equity in your home matters far more than how bad your credit looks right now.

Most people in this position assume there are only two roads — somehow find the arrears, or sell before the bank takes the house. There is very often a third, and it runs through the equity already sitting in the property.

Why Alberta gives you more room than you think

Alberta foreclosures run through the Court of King’s Bench. It is a court process, not the fast power-of-sale procedure used in some other provinces, and the court sets a redemption period during which a homeowner can bring the mortgage current or pay it out. That normally means more time than people fear.

It also means the opposite of what panic tells you to do. Time is the asset here, and it depletes: every week that passes adds interest, legal costs and complexity, and narrows what a lender is willing to do. The cheapest call is always the earliest one.

What can actually be done

  • A private second mortgage to clear arrears and stop the action, secured against your equity rather than your credit score.
  • Paying out judgments, liens or writs registered on title — these have to be cleared before any mainstream lender will refinance you.
  • Structuring the rescue so it has no monthly payment, by building the interest into the loan, so you can stay current on your first mortgage instead of drowning in two.
  • A deliberate credit rebuild over the following months, so a normal lender can take over.
  • A refinance that consolidates everything into one payment you can actually carry — ideally timed to a renewal date so no breakage penalty applies.

This works when there is real equity and real income. If there is not, you deserve to hear that early rather than after spending money on fees — and sometimes the right answer genuinely is to sell on your own terms rather than the court’s, which is still far better than a forced sale.
